– Social media content publishing and management, including automated publishing to TikTok on behalf of clients and our own brands

Our TikTok integration (“TikTok Integration”) enables Silver Sense Digital to publish video content to TikTok accounts — both for our agency clients and for brands managed by Silver Sense Digital. This integration is operated as a professional marketing platform service, not for personal use.

3. TIKTOK INTEGRATION AND DATA
Silver Sense Digital’s integration with TikTok is governed by TikTok’s own Terms of Service and Platform Policies in addition to these Terms.

By authorising Silver Sense Digital to access your TikTok account as part of our Services, you grant us permission to:
– Access your TikTok account information necessary to provide the Services
– Publish video content to your TikTok account on your behalf
– Retrieve performance data and analytics related to published content

We will only access TikTok data that is necessary to deliver the agreed Services. We will not sell, share, or use your TikTok data for any purpose beyond providing our Services to you.

You may revoke Silver Sense Digital’s access to your TikTok account at any time through your TikTok account settings. Revoking access may limit our ability to deliver certain Services.

4. ELIGIBILITY AND ACCOUNT RESPONSIBILITIES
To use our Services, you must:
– Be at least 18 years of age
– Have the legal authority to enter into these Terms on behalf of yourself or your organisation
– Provide accurate and complete information when engaging with Silver Sense Digital

You are responsible for ensuring that any content you provide to Silver Sense Digital for publishing complies with TikTok’s Community Guidelines, our content standards, and all applicable laws and regulations in your jurisdiction.

5. ACCEPTABLE USE
You agree not to use Silver Sense Digital’s Services to:
– Publish content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable
– Violate TikTok’s Terms of Service or Community Guidelines
– Infringe upon the intellectual property rights of any third party
– Engage in spam, misleading advertising, or deceptive practices
– Interfere with or disrupt any platform or third-party service

Silver Sense Digital reserves the right to refuse or remove any content that violates these Terms or that we determine, in our sole discretion, is inappropriate.

6. INTELLECTUAL PROPERTY
All content, branding, designs, and materials created by Silver Sense Digital remain the intellectual property of Silver Sense Digital unless otherwise agreed in writing. Content provided by clients for publishing remains the intellectual property of the respective client.

By providing content to Silver Sense Digital for publication, you grant us a non-exclusive, royalty-free licence to use, reproduce, and publish that content solely for the purpose of delivering the agreed Services.

7. DISCLAIMERS AND LIMITATION OF LIABILITY
Silver Sense Digital’s Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the availability, accuracy, or fitness for a particular purpose of our Services.

Silver Sense Digital does not guarantee specific results from digital marketing campaigns, social media publishing, or SEO Services, as outcomes depend on many factors outside our control.

To the maximum extent permitted by applicable law, Silver Sense Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, including any disruptions to third-party platforms such as TikTok.

Silver Sense Digital is not responsible for changes to TikTok’s platform, API, or policies that may affect the delivery of our Services.

8. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to conflict of law principles.
